Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Muxara(“Muxara”, “we”, “us”) website and online media converter at muxara.com. They do not cover the Muxara macOS app - see the Muxara macOS App Terms of Service. By using the website and web converter, you agree to these Terms. If you do not agree, do not use those services.

Our services

Muxara provides a free cloud-based web converter to upload media, convert it on our infrastructure, and download the result. Features, formats, pricing, and availability may change over time. We may enable, modify, or discontinue features at any time. For the free Muxara macOS app, see the Mac app Terms of Service.

Eligibility

You must be old enough to form a binding contract where you live and have the legal right to use the content you upload or process. If you use the services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Acceptable use

You agree not to:

• Upload, convert, or distribute content you do not have the right to use, including material that infringes copyright, trademark, or other intellectual property
• Use the services for unlawful purposes or to violate any applicable law or regulation
• Upload malware, attempt to probe or disrupt our systems, or circumvent rate limits, payment requirements, or security measures
• Use the services to process content that is illegal, exploitative, or harmful
• Resell, scrape, or automate access to the web converter in a way that burdens our infrastructure or violates these Terms

We may investigate violations, remove content, cancel jobs, refuse service, and cooperate with law enforcement where required.

Prohibited content and reporting

Uploading illegal or otherwise prohibited material to the web converter is strictly prohibited. You must not upload content that violates applicable law, infringes intellectual property, contains malware, or is exploitative, harmful, or otherwise unacceptable.

If you become aware of any prohibited or illegal material on muxara.com, notify us immediately at [email protected] with enough detail for us to locate it (for example, a job identifier, URL, or timestamp). We will investigate and work to remove it promptly.

Web converter: uploads and processing

When you use the online converter, you upload files to temporary secure cloud storage using signed URLs. Files are processed on our infrastructure. Job status and operational data may be stored in our systems.

You retain ownership of your content. You grant Muxara a limited, non-exclusive license to host, process, transmit, and delete your files solely to provide the conversion service you request. We do not claim ownership of your media.

Uploaded and converted files are automatically deleted within 24 hours under normal operation. You are responsible for downloading results before they expire. We are not obligated to recover deleted files.

Free mode

In free mode, the web converter has no charge. You can convert and download files at no cost, subject to a 500 MB upload limit per file and fair-use rate limits. We may switch to paid pricing in the future; we will update these Terms before any charges apply.

We do not require user accounts for basic use. Each conversion is tracked by a job identifier rather than a permanent account.

Intellectual property

Muxara's website, apps, branding, software, and documentation are protected by intellectual property laws. Except for the limited rights explicitly granted in these Terms, we reserve all rights. You may not copy, modify, reverse engineer, or create derivative works of our services except where permitted by law or open-source licenses that apply to included components.

Third-party services

Our services rely on third-party providers for hosting, storage. Their availability and performance are outside our direct control.

Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, MUXARA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Conversion results depend on your source files, chosen settings, and format compatibility. We do not guarantee that every file will convert successfully, that output will meet a particular quality standard, or that the services will be uninterrupted or error-free.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MUXARA AND ITS OPERATORS, AFFILIATES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID TO MUXARA FOR THE SPECIFIC CONVERSION OR TRANSACTION GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE EVENT, OR (B) FIFTY U.S. DOLLARS (USD $50).

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify and hold harmless Muxara from claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, your use of the services, or your violation of these Terms or applicable law.

Suspension and termination

We may suspend or terminate access to the services at any time if we reasonably believe you violated these Terms, pose a security or legal risk, or if we discontinue a product. You may stop using the services at any time. Sections that by their nature should survive (including disclaimers, limitation of liability, and indemnification) will survive termination.

Changes to these Terms

We may update these Terms as our products and legal requirements evolve. We will post the updated Terms on this page and revise the “Last updated” date. Continued use after changes become effective constitutes acceptance of the revised Terms. If you do not agree, you must stop using the services.

Governing law

These Terms are governed by the laws of the United States, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in the United States, unless applicable law requires otherwise. You consent to personal jurisdiction in those courts.
